By accessing or using GTS CostPro ("the Service," "Platform," or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including:

• Free trial users
• Weekly Pass subscribers
• Monthly Pro subscribers
• Visitors browsing our website

2. Description of Service

GTS CostPro is an AI-powered platform that provides soft cost estimates for real estate development projects. Our service includes:

• Automated cost estimation using artificial intelligence
• Location-specific cost analysis
• Detailed breakdowns of soft costs (architecture, engineering, permits, legal, etc.)
• Risk analysis and recommendations
• PDF export and estimate history (Monthly Pro only)

3. User Accounts

3.1 Account Creation

To use GTS CostPro, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

3.2 Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Ensuring your account information is current and accurate
• Complying with all applicable laws and regulations

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse or misuse the Service
• Fail to pay subscription fees

4. Subscription Plans and Billing

4.1 Weekly Pass ($75/week)

• Duration: 7 days from purchase
• Estimates: 7 soft cost estimates
• Billing: One-time payment, no auto-renewal
• Access: Automatically expires after 7 days

4.2 Monthly Pro ($250/month)

• Duration: Monthly recurring subscription
• Estimates: Unlimited
• Billing: Automatically renews monthly
• Cancellation: Cancel anytime; access continues until end of billing period
• Benefits: PDF export, estimate history, priority support, 15% EFC discount

4.3 Payment Terms

• Payments are processed securely through Stripe
• All fees are in USD unless otherwise stated
• Subscription fees are non-refundable except as required by law
• You authorize us to charge your payment method for all fees incurred
• If payment fails, we may suspend your access until payment is received

4.4 Price Changes

We reserve the right to change our pricing. We will notify you at least 30 days before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.5 Cancellation and Refunds

• Weekly Pass: Non-refundable once purchased
• Monthly Pro: You can cancel anytime from your account settings. No refunds for partial months
• Exceptional Cases: Refund requests may be considered on a case-by-case basis by contacting eliza@efcbrand.com

5. Acceptable Use

5.1 Permitted Use

You may use GTS CostPro for:

• Evaluating soft costs for your real estate development projects
• Planning and budgeting purposes
• Internal business analysis

5.2 Prohibited Use

You may NOT:

• Resell, redistribute, or share your account access
• Use the Service to generate estimates for others commercially
• Reverse engineer, decompile, or attempt to extract our AI models
• Use automated tools to scrape or extract data from the platform
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal purpose
• Circumvent usage limits or access restrictions
• Attempt to gain unauthorized access to any part of the Service

6. Intellectual Property

6.1 Our Rights

GTS CostPro and all related intellectual property are owned by us or our licensors. This includes:

• The website, platform, and software
• AI models and algorithms
• Logos, trademarks, and branding
• Content, text, graphics, and design
• Cost estimation methodologies

6.2 Your Rights

You retain all rights to:

• The project data you input into the Service
• The cost estimates generated for your projects

6.3 License Grant

We grant you a limited, non-exclusive, non-transferable license to use GTS CostPro for your internal business purposes in accordance with these Terms.

By using the Service, you grant us a license to use your project data (in an aggregated, anonymized format) to improve our AI models and services.

7. Disclaimers and Limitations

7.1 Service "As Is"

GTS CostPro is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of estimates

7.2 Estimate Accuracy

• Local market conditions and fluctuations
• Specific project requirements and complexity
• Regulatory changes and permit requirements
• Economic conditions and material costs
• Contractor availability and pricing
• Unforeseen circumstances

You should always:

• Verify estimates with qualified professionals
• Obtain detailed quotes from contractors and service providers
• Conduct thorough due diligence
• Build contingency buffers into your budget

7.3 No Professional Advice

GTS CostPro does not provide:

• Financial advice
• Legal advice
• Architectural or engineering services
• Professional consultation

Always consult with licensed professionals for your specific needs.

7.4 Service Availability

We do not guarantee that the Service will be:

• Available at all times without interruption
• Free from errors, viruses, or bugs
• Compatible with all devices or browsers

We may suspend or terminate the Service for maintenance, updates, or other reasons with or without notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• GTS CostPro and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for any losses, damages, or costs resulting from your reliance on our estimates
• We are not liable for any business losses, lost profits, lost revenue, lost data, or economic loss

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless GTS CostPro, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your project data or actions

10. Privacy and Data

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.
